State Police resources are tapped in on-going investigation

Since the last public update of October 8, 2011, by the Middlesex County Prosecutorís Office into the status of the investigation of the shooting of New Brunswick resident Barry E. Deloatch, the investigation remains active and ongoing.

Investigators from the Middlesex County Prosecutorís Office are continuing in their efforts to identify and interview anyone who may have knowledge of the shooting on September 22, 2011. Investigators are reviewing the statements already obtained from 38 witnesses and will be re-questioning at least some of them. In addition, video and audio tapes from police vehicles have been secured.

As was previously reported, evidence seized from the scene by the Middlesex County Prosecutorís Office investigators has been submitted to the New Jersey State Police Office of Forensic Science for testing and analysis.

Additionally, the Middlesex County Prosecutorís Office has sought the assistance of the New Jersey State Police Forensic Investigation Bureau, which has been asked to independently review the events that occurred in the alley where the shooting occurred.

To assist in our efforts to forensically re-construct and diagram the scene, the New Jersey State Police Forensic Investigation Bureau has taken laser measurements and the New Jersey State Police Aviation Bureau has assisted the Middlesex County Prosecutorís Crime Scene Response Unit in taking aerial photographs.

The next steps in the procedure will be to ensure that all witnesses have been identified and their statements taken and reviewed; that medical records and the results of all scientific testing have been received, and the video and audio tapes from the police vehicles have been reviewed and analyzed.

Once those tasks are completed, the Middlesex County Prosecutorís Office will make a final determination on whether to present the matter to a Middlesex County grand jury sitting in New Brunswick.

This decision will be based upon the results of the investigation and in accordance with the Attorney Generalís guidelines on shootings involving police. Once that decision is made, it will be discussed first with the Deloatch family and then will be made public.

Additional updates will follow as events allow.
